There Is No Pennsylvania Workplace Accident Case That Is Too Complex For Us

No matter what type of workplace accident caused your injuries, we can help. In all cases, receiving prompt medical attention is a top concern. Our Lancaster workplace accident attorneys can help you gather vital medical evidence to help you claim benefits for any type of injury you are suffering from, including:

    Back or spinal cord injury

Injuries to the back and spinal cord can have a variety of functional consequences, from paralysis to pain, and more.

    Leg, knee or ankle injury

Leg, knee, and ankle injuries can require extensive medical care and rehabilitation treatment to resolve, and often lead to long-term impairments.

    Repetitive motion or stress injury

Repetitive motion injuries are covered by workers’ compensation.  These injuries may not initially seem to be work-related, but a full medical evaluation can help identify the work-related causes.

    Loss of a limb

The loss of a limb can lead to a long-term impairment that prevents one from returning to work in a significant capacity.

    Burn injuries and scarring

Burn injuries and scarring can not only lead to functional impairments (and substantial pain) but can also cause mental anguish due to aesthetic losses.

    Head or traumatic brain injury

Traumatic brain damage can give rise to significant impairments and may not be obvious in the initial stages of an injury.

Heart attack or any other traumatic heart condition

Heart attack cases can be challenging, as there will be an evaluation of whether there was some pre-existing condition or other non-work-related aspect that contributed to the injury.

    Lifting Accidents

As more and more workers suffer from poor posture, diet, and a lack of exercise, the risk of an injury-causing lifting accident increases.

    Occupational Diseases/Toxic Exposure

Exposure to toxic substances could lead to significant losses that are covered by workers’ compensation.  If the employer was sufficiently reckless in exposing employees, then a direct lawsuit may be possible.

    Hand and wrist injuries

Hand and wrist injuries can be extremely painful and can result in permanent disability. In severe cases, the result can be amputation of the hand or fingers.

    Vision and hearing loss

Both vision and hearing loss can result from a number of workplace factors. Treatments and care associated with vision and hearing loss can be very costly and it is not uncommon for these types of work environment-related injuries to be permanent.

Our Lancaster Workplace Accident Attorney Explains Fault in Job Accidents

Generally speaking, fault or blame is not relevant to workers’ compensation claims, except in limited circumstances.  Pennsylvania law applies strict liability principles to workers’ compensation claims.  Put simply, an injured worker may recover workers’ compensation benefits, even if their own negligent conduct partially contributed to their injuries.  Blame is primarily relevant with regard to “third-parties” who may have contributed to the worker’s injuries (thus exposing them to potential liability in a separate lawsuit).

What Steps Should Employers Take to Reduce the Risk of Getting Injured on the Job?

Employers should take proactive steps to minimize the risk of harm that their employees are exposed to while on-the-job.  Though compliance with various safety regulations is important, it is a bare minimum “first step.”  Employers can proceed with a more comprehensive safety plan by:

    • Consulting with safety experts to evaluate the workplace and its hazards
    • Developing new safety protocols
    • Training employees to comply with safety protocols
    • Conducting internal surveys relating to workplace safety to allow employees to raise their own concerns

Can I Treat My Injuries With My Own Doctor?

One of the frequent concerns of our clients is whether they can seek treatment from their primary care provider. We understand that you trust your own doctor and would prefer to see a familiar physician. In Pennsylvania, your employer and its workers’ compensation insurance carrier control your treatment for the first 90 days after you begin treating for an injury. After that time, you will be able to seek treatment from any doctor you choose.

At any time, before or after the first 90 days, the insurance carrier may send you to an independent medical examination (IME). Using this examination, the insurer can review and challenge your medical treatment.
